Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Firefighter Academy website and online test-preparation service (the "Service"), operated by Firefighter Academy ("Firefighter Academy", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who you are contracting with

The Service is provided by Firefighter Academy. By using the Service you confirm that you are of legal age to enter into a binding agreement and, if using the Service on behalf of an organization, that you have authority to bind that organization.

The Service

Firefighter Academy provides practice questions, simulated exams, analytics, and related study materials to help applicants prepare for firefighter aptitude tests (including OFAI FACT and CPS style assessments). Firefighter Academy is an independent study aid and is not affiliated with, endorsed by, or sponsored by OFAI, CPS, or any municipal fire service. Practice questions are original preparation materials and are not actual exam questions.

Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or abusive purpose;
• send spam or attempt to defraud us or other users;
• infringe our intellectual property or that of any third party;
• copy, scrape, resell, or redistribute our questions or content;
• introduce malware, probe, scan, or otherwise interfere with the security or integrity of the Service.

Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

Intellectual property

We retain all ownership of the Service and its content, including software, question banks, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own personal exam preparation within the plan you have purchased. You may not reverse engineer, resell, or circumvent any technical limitations of the Service.

Payment, subscriptions, and renewals

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. The 12-Month Full Access Pass grants access for the period stated at checkout.

Service availability

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee that using the Service will result in passing any test.

Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and you submit to the courts located there for any dispute, without prejudice to mandatory consumer protections in your place of residence.

Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
