These Terms & Conditions ("Terms") govern your access to and use of the Firefighter Academy website and online test-preparation service (the "Service"), operated by Firefighter Academy ("Firefighter Academy", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Independent educational platform

Firefighter Academy is an independent educational platform providing original practice materials designed to help candidates prepare for firefighter aptitude testing. We are not affiliated with, endorsed by, or sponsored by any fire department, municipality, testing organization, government agency, or examination provider. All trademarks remain the property of their respective owners and are referenced only for identification and descriptive purposes.

Educational purposes only

All content on the Service — including practice questions, simulated exams, explanations, analytics, and articles — is provided for general educational and test-preparation purposes only. Our questions are original materials authored by Firefighter Academy. They are not actual examination questions and are not reproduced from any official or proprietary test. Content does not constitute legal, employment, medical, or professional advice, and eligibility requirements and recruitment processes vary by department and change over time; always confirm requirements directly with the relevant fire service or testing body.

Who you are contracting with

The Service is provided by Firefighter Academy, based in Ontario, Canada. By using the Service you confirm that you are of legal age to enter into a binding agreement and, if using the Service on behalf of an organization, that you have authority to bind that organization.

The Service

Firefighter Academy provides original practice questions, simulated exams, analytics, and related study materials for firefighter aptitude testing (including FACT and CPS-style assessments) and, where offered, licensing, endorsement, vehicle-operation, and certification preparation. We may correct errors and update educational content as necessary. We will make reasonable efforts to maintain the functionality and value of purchased services, subject to applicable consumer protection laws.

Independent testing and recruitment decisions

We do not administer, control, develop, score, or influence any official firefighter aptitude examination, recruitment process, licensing examination, or certification assessment. Examination providers, municipalities, employers, and government authorities independently determine testing requirements, examination content, difficulty, scoring methods, passing standards, scheduling, eligibility criteria, and hiring decisions. These requirements may change at any time without notice to Firefighter Academy. We are not responsible for decisions, changes, cancellations, or outcomes determined by these independent third parties, subject to the consumer rights preserved in these Terms.

No guarantee of results or employment

Our practice tests are independently developed educational simulations, not official examinations. We do not guarantee that our questions will match the content, wording, difficulty, length, structure, or scoring of any particular examination. Practice scores, completion times, progress reports, and readiness indicators are educational feedback only and do not establish or guarantee readiness, a passing score, certification, an interview, placement on an eligibility list, or employment. Individual results depend on many factors, including prior knowledge, study habits, test-day performance, and the official selection process. Testimonials reflect individual experiences and are not a promise of similar results.

Accuracy and changes to information

We make reasonable efforts to provide accurate, relevant, and up-to-date educational materials. Despite these efforts, materials may contain errors, omissions, outdated information, or differences from current official testing requirements. Users should independently verify current examination requirements, eligibility criteria, licensing standards, and recruitment information with the relevant official authority.

To report a suspected error or outdated information, use our contact page. Please identify the question or lesson and describe the concern. We review reports and correct confirmed errors as appropriate. Reporting an error does not limit any applicable consumer rights.

Individual responsibility and expenses

Users are responsible for their own preparation decisions, examination registrations, employment applications, and compliance with applicable testing and licensing requirements. We do not control or collect fees charged by external examination providers, municipalities, licensing authorities, training institutions, or employers. Users should independently confirm official requirements before incurring third-party examination fees, application costs, travel expenses, training costs, or other related expenditures.

Licensing, endorsements, and certification preparation

Any driver-licensing, licence-class, endorsement, vehicle-operation, or certification preparation materials offered through Firefighter Academy, including Class D and Z endorsement preparation, are independent educational study aids. Unless expressly stated and supported by the relevant authorization, they do not constitute government-approved training, practical instruction, licensing, or certification. Online study does not replace required training, official handbooks, applicable laws, or assessments administered by authorized bodies. Requirements vary by jurisdiction and may change; users must verify current requirements with the relevant authority.

Jurisdiction and safe use

Materials identified for a particular province, territory, or country may not apply elsewhere, even where licence classes or endorsements have similar names. Lessons, explanations, and diagrams are for study purposes and must not be relied on as operating instructions while driving, inspecting, repairing, or handling vehicles or equipment. Follow current official instructions, applicable laws, and required practical training.

Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or abusive purpose;
• send spam or attempt to defraud us or other users;
• infringe our intellectual property or that of any third party;
• copy, scrape, resell, or redistribute protected content except as permitted by applicable law or expressly authorized in writing;
• introduce malware, probe, scan, or otherwise interfere with the security or integrity of the Service.

Your account responsibilities

You must provide accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Accounts are personal and non-transferable: you may not share, sell, or allow others to use your access. Notify us promptly if you believe your account has been used without your authorization.

Intellectual property

Firefighter Academy's original questions, answer explanations, learning materials, diagrams, graphics, software, branding, and original selection and arrangement of educational content are protected by applicable intellectual-property laws. We retain ownership of our original content. Third-party names and marks remain the property of their respective owners.

Users receive a limited, personal, non-exclusive, non-transferable licence to access content for their own educational preparation during their authorized access period. Except as permitted by applicable law or expressly authorized in writing, users may not reproduce, publish, distribute, sell, sublicense, systematically download, scrape, or commercially exploit protected content, create derivative works from it, reverse engineer protected software, or circumvent access controls.

Users may not use protected Firefighter Academy content to construct, populate, or train a competing question bank, commercial preparation service, or artificial-intelligence dataset without prior written authorization, except as permitted by applicable law. Unauthorized account sharing, automated content harvesting, resale of access, or circumvention of access controls may result in suspension or termination in accordance with these Terms and applicable law.

Payment and refunds

We use Stripe as our payment processor. Payment and billing information is submitted to Stripe to process purchases, refunds, and related payment services. We do not store your full payment card number. Stripe handles personal information in accordance with its Privacy Policy. Firefighter Academy remains responsible for providing the purchased Service and handling customer support and refund requests under our Refund Policy and applicable law. Prices are shown in Canadian dollars unless stated otherwise. Applicable taxes and the total payable are displayed at checkout before payment.

We offer a 14-day money-back satisfaction guarantee on the 12-Month Full Access Pass (FACT/CPS) and a 7-day money-back satisfaction guarantee on Class D Only, Z Air Brake Only, and Complete DZ passes. Neither guarantee promises an official exam pass. Full details and eligibility are set out in our Refund Policy, which forms part of these Terms.

Purchased access and additional products

Your purchase includes the product, features, and access period described in the offer and at checkout. Separate products, licence categories, courses, or services introduced later are not automatically included unless expressly stated in your purchase. This does not remove content updates or other benefits already promised for your purchased product.

Service availability

We make reasonable efforts to maintain the availability, reliability, and security of our platform. Temporary interruptions may occur because of scheduled maintenance, technical issues, internet connectivity, hosting providers, payment processors, third-party infrastructure, or circumstances beyond our reasonable control. We do not guarantee uninterrupted or error-free access to the Service. To the extent permitted by applicable law, we are not liable for delays or interruptions caused by events beyond our reasonable control. This does not excuse our own failure to meet obligations that cannot lawfully be excluded or limited. Where a substantial interruption affects purchased access, we will address the circumstances reasonably and in accordance with applicable law and our contractual obligations.

Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

Consumer rights

Nothing in these Terms excludes, restricts, or limits any consumer rights, statutory remedies, warranties, or liabilities that cannot lawfully be excluded or limited under applicable legislation, including Ontario consumer protection law.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and you submit to the courts located in Ontario for any dispute. Nothing in these Terms limits any non-waivable right you have under the Ontario Consumer Protection Act, 2002 or other mandatory consumer protection law in your place of residence.

Changes

We may update these Terms from time to time and will reflect updates in the date above. We will provide reasonable notice of material changes and obtain consent where required by applicable law. Updates do not retroactively remove rights relating to existing purchases or reduce the access period or refund rights already promised to a customer. Posting revised Terms does not by itself establish that an existing customer has accepted them.
