These Terms & Conditions ("Terms") govern your access to and use of the Firefighter Academy website and online test-preparation service (the "Service"), operated by Firefighter Academy ("Firefighter Academy", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Independent educational platform

Firefighter Academy is an independent educational platform providing original practice materials designed to help candidates prepare for firefighter aptitude testing. We are not affiliated with, endorsed by, or sponsored by any fire department, municipality, testing organization, government agency, or examination provider. All trademarks remain the property of their respective owners and are referenced only for identification and descriptive purposes.

Educational purposes only

All content on the Service — including practice questions, simulated exams, explanations, analytics, and articles — is provided for general educational and test-preparation purposes only. Our questions are original materials authored by Firefighter Academy. They are not actual examination questions and are not reproduced from any official or proprietary test. Content does not constitute legal, employment, medical, or professional advice, and eligibility requirements and recruitment processes vary by department and change over time; always confirm requirements directly with the relevant fire service or testing body.

Who you are contracting with

The Service is provided by Firefighter Academy, based in Ontario, Canada. By using the Service you confirm that you are of legal age to enter into a binding agreement and, if using the Service on behalf of an organization, that you have authority to bind that organization.

The Service

Firefighter Academy provides original practice questions, simulated exams, analytics, and related study materials to help applicants build the skills commonly assessed in firefighter aptitude testing (including FACT and CPS-style assessments). Features, question banks, and content may be updated, added, or removed over time as we improve the Service.

No guarantee of results or employment

We do not guarantee any particular outcome. Using the Service does not guarantee a passing score on any test, selection for an interview, placement on an eligibility list, or employment or hiring by any fire service or employer. Individual results depend on many factors outside our control, including prior knowledge, study habits, test-day performance, and the official selection process of the relevant fire service or testing agency. Any testimonials or results shown on our website reflect individual experiences and are not a promise of similar results.

Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or abusive purpose;
• send spam or attempt to defraud us or other users;
• infringe our intellectual property or that of any third party;
• copy, scrape, resell, or redistribute our questions or content;
• introduce malware, probe, scan, or otherwise interfere with the security or integrity of the Service.

Your account responsibilities

You must provide accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Accounts are personal and non-transferable: you may not share, sell, or allow others to use your access. Notify us promptly if you believe your account has been used without your authorization.

Intellectual property

We retain all ownership of the Service and its content, including software, original question banks, explanations, documentation, and branding. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal exam preparation within the plan you have purchased. You may not copy, record, screenshot for redistribution, scrape, resell, publish, reverse engineer, or create derivative works from our content, or circumvent any technical limitation of the Service. Third-party names and marks referenced on the Service remain the property of their respective owners.

Payment and refunds

Purchases are processed by a third-party payment processor acting as merchant of record for the transaction. Payment, billing, currency, tax, and invoicing are handled by that processor under its own buyer terms; we do not store your full payment card details. Prices are shown in Canadian dollars unless stated otherwise at checkout, and the 12-Month Full Access Pass grants access for the period stated at checkout.

We offer a 14-day money-back guarantee on the 12-Month Full Access Pass. Full details and eligibility are set out in our Refund Policy, which forms part of these Terms.

Accessibility

Service availability

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee that using the Service will result in passing any test.

Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and you submit to the courts located in Ontario for any dispute. Nothing in these Terms limits any non-waivable right you have under the Ontario Consumer Protection Act, 2002 or other mandatory consumer protection law in your place of residence.

Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
